Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Cinemr platform operated by Cinemr Pty Ltd, a company incorporated in Australia (“Cinemr Pty Ltd”, “Cinemr”, “we”, “our”, “us”). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform. 1. Eligibility You must: • Be at least 13 years old to create a Voice account • Provide accurate and complete information • Have the legal capacity to enter into a binding agreement By using Cinemr Pty Ltd, you confirm you meet these requirements. 2. Accounts You are responsible for: • Maintaining the confidentiality of your login credentials • All activity under your account • Not sharing access without authorization Cinemr Pty Ltd is not liable for losses arising from unauthorized account use. 3. Acceptable Use You agree not to: • Upload unlawful, defamatory, harmful, or infringing content • Violate intellectual property rights • Harass or threaten other users • Distribute malware or attempt to disrupt platform functionality • Use automated scraping tools without permission We reserve the right to investigate and take action where violations occur. 4. Content Ownership & License Voices retain full ownership of their uploaded content. By uploading content to Cinemr, you grant Cinemr Pty Ltd, its affiliates, successors, and assigns a non-exclusive, worldwide, royalty-free, sublicensable, perpetual license to: • Host • Stream • Broadcast • Display • Reproduce • Distribute • Publish • Promote • Create excerpts or clips • Transcribe • Adapt format for platform functionality • Edit, compile, combine, excerpt, or incorporate the content into documentaries, trailers, promotional materials, and other platform features across the Cinemr platform and related marketing channels, including but not limited to websites, mobile applications, social media, newsletters, advertisements, and promotional campaigns. This license is granted for the purpose of operating, promoting, improving, and expanding the Cinemr platform and its documentary productions. The license granted to Cinemr Pty Ltd is perpetual and irrevocable with respect to content that has already been published, distributed, or incorporated into Cinemr documentaries, platform features, or marketing materials, even if the contributor later removes the content or terminates their account. Uploaded content may remain part of Cinemr documentaries, archives, or historical film records as part of the platform’s evolving documentary format. By uploading content, you also grant Cinemr Pty Ltd the right to use your name, image, voice, likeness, biography, credentials, and professional identity in connection with the promotion, marketing, and distribution of Cinemr and related productions. You represent and warrant that: • You own or control all rights necessary to grant this license. • Your content does not infringe the rights of any third party. • Any music, images, or third-party material included has appropriate permission. • You are solely responsible for the accuracy, legality, and claims made within your content. 5. No Compensation or Revenue Rights Except where explicitly agreed in a separate written agreement with Cinemr Pty Ltd, contributors acknowledge and agree that uploading content to the platform does not entitle them to compensation, royalties, revenue participation, equity, or ownership interest in Cinemr Pty Ltd or in any Cinemr documentary, platform feature, or production. Participation on the Cinemr platform is voluntary unless otherwise agreed in writing. Cinemr Pty Ltd may, at its sole discretion, introduce revenue-sharing programs, premium features, collaborations, or promotional opportunities in the future. Participation in any such program will be governed by separate terms. Nothing in these Terms shall be interpreted as creating a partnership, joint venture, employment relationship, or profit-sharing arrangement between Cinemr Pty Ltd and any contributor. 6. Editorial Control & Content Continuity Cinemr Pty Ltd retains full editorial control over how content is organized, presented, edited, and incorporated within the platform and its documentary productions. Contributors acknowledge that Cinemr documentaries are designed as evolving, collaborative works that may include content from multiple independent Voices. Cinemr Pty Ltd may determine how contributions appear within a film, including their placement, sequencing, editing, and association with other contributors. Where content has already been published, incorporated into a documentary, or used in promotional materials, Cinemr Pty Ltd may retain the content as part of the documentary record even if a contributor later removes their content or terminates their account. Cinemr Pty Ltd may also archive, preserve, or maintain previously published documentary segments as part of the platform’s historical record. Nothing in these Terms obligates Cinemr Pty Ltd to modify or remove content solely because a contributor later changes their views or preferences. 7. Platform Protection & Non-Solicitation Cinemr Pty Ltd invests significant resources in building curated documentary ecosystems and contributor communities. Users and contributors agree that they will not use the Cinemr platform to: • Solicit other contributors to leave the platform • Recruit Cinemr contributors for competing platforms or services • Attempt to replicate Cinemr documentary structures using contributor networks obtained through the platform • Harvest contributor contact information for commercial solicitation without consent Nothing in this clause prevents individuals from independently participating in other platforms or media projects. However, the use of the Cinemr platform or contributor network to intentionally replicate or undermine the Cinemr ecosystem is prohibited. Cinemr Pty Ltd reserves the right to suspend or terminate accounts engaged in such activity. 8. Moderation & Removal Cinemr is a curated platform. Cinemr Pty Ltd reserves the right to: • Approve or reject uploaded content • Remove content at its discretion • Suspend or terminate accounts for policy violations We are not obligated to publish all submissions. 9. Platform Changes Cinemr Pty Ltd may: • Modify features • Introduce paid services • Change Upload Credit systems • Update these Terms Cinemr Pty Ltd may also modify how contributor content is organized, displayed, edited, or presented within the evolving documentary format. Cinemr Pty Ltd reserves the right to modify, suspend, or discontinue any aspect of the platform, features, or services at any time, with or without notice. 10. Disclaimers All content is provided for informational and educational purposes only. Nothing on Cinemr constitutes: • Medical advice • Financial advice • Legal advice • Professional services Users act at their own risk when applying information from the platform. 11. Limitation of Liability To the fullest extent permitted by law, Cinemr Pty Ltd shall not be liable for: • Indirect or consequential damages • Loss of income or opportunity • Reliance on user-generated content • Platform interruptions Use of the platform is at your own risk. 12. Governing Law These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia. Continued use of the platform constitutes acceptance of updated Terms.
